After divorce, former spouses can’t prevent the other from using his name – High Court Judge

After a divorce, an ex-husband cannot prevent his former partner from using his last name.

According to High Court Judge Justice Alexander Osei Tutu, no one owns a name, so individuals are free to use any name they choose. He explained that without a statutory law preventing others from using the name, this remains the case.

This principle was illustrated by a case in England where a woman continued to use her royal ex-husband's name after their divorce, and the court upheld her right to do so.

Therefore, even after a divorce, one person cannot demand that the other change their name.
