The International Chamber of Commerce (ICC) has dismissed a case brought by Micheletti Company Limited against the Ghanaian government regarding a breach of contract for the Accra Sports Stadium rehabilitation.
The ICC Tribunal ruled that the arbitration proceedings were initiated beyond the time limit specified by Ghana's Limitation Act and were therefore statute-barred.
The government had argued that the claim, filed over 14 years after the cause of action arose, was time-barred.
The Tribunal agreed, dismissing Micheletti's claims entirely, with costs to be awarded to the government.
