State files evidence for prosecution of NDC National Chairman

State Prosecutors have filed several documents at the registry of the High Court hearing the Case of the Republic versus Samuel Ofosu Ampofo and another being the evidence they intend to rely on in prosecuting their case against the two accused persons.

The Director of Public Prosecutions, Yvonne Atakora Buabisa addressing Justice Samuel Asiedu’s Court said the State filed the documents this morning because one of the evidence they planned to file delayed hence their inability to file based on the timelines given by the Court.

The DPP added that among the details filed are the investigation caution statements of the accused persons, the charge statements, a compact disk (CD) recording of the said tape, a forensic report as well as a transcript of the audio recording in question.

The Court’s enquiry from the defense team lead by lawyer Tony Lithur, showed that they are yet to be served with the list of documents and evidences the State intends to rely on. The Court was invited to order that the defense team be served with all that the Attorney General’s department has filed.

The defense team will then have the liberty to respond to all that the AG has submitted to Court as well as to build their defense.

Dr Abdul Basit Bamba, lawyer for the second accused person, Kwaku Boahen, indicated to the Court that he has filed a document at the registry of the Court as at the 3rd day of May 2019 (A lalabie) which will show that his client was not present in Greater Accra at the NDC National headquarters on the said day of the meeting where the audio was recorded which is the 3rd of February 2019.

Justice Samuel Asiedu, in response said he yet to see it but will certainly take a look at it and deal with it appropriately.

Sitting was subsequently adjourned to 27th of May 2019, by which time both parties would have had ample time to compile with the orders of the Court.

The two accused persons, National Chairman of the National Democratic Congress (NDC), Samuel Ofosu-Ampofo (First Accused) and and Kwaku Boahen (Second Accused), the Deputy Director of Communications of the NDC were both in court.

The First Accused person was represented in Court by Tony Lithur, Marietta Brew-Oppong and Dr Dominic Ayine. The second accused was represented by Dr Abdul Basit Bamba and Baba Jamal.
