Francis-Xavier Sosu, MP for Madina Constituency, has criticized the Supreme Court’s decision to reverse Speaker Alban Bagbin’s expulsion of four MPs, describing it as a move that deepens the country’s constitutional challenges.
The court, in a 5-2 decision, ruled that expelling MPs for switching political affiliations mid-parliament is unconstitutional. However, Sosu argued on Starr Chat that the ruling complicates the legal landscape rather than resolving the issue.
He emphasized that constitutional interpretation should prioritize clarity and avoid absurd outcomes.
“The ordinary meaning rule should apply unless it leads to absurdity or ambiguity. This ruling, however, leads to absurdity,” he remarked.
Sosu expressed concerns about the broader implications of the decision, calling for deeper reflections on constitutional interpretation.
