Odeneho Odehye Nanaba Osei Bonsu, the president of Achama Tutuwaa Royal Family Council of Boadi has called on the government and the National House of Chiefs to advise Asantehene Osei Tutu II including Ashanti Regional Lands Commssion to comply with Section 2 (b) and Section 207 of the Land Act 1036 2020.

Asantehene’s conduct undermines the supremacy of the Rule of Law as well as gross disrespect to the cultural heritage of Asantehene Osei Tutu I, Bearer of the Ashanti Golden stool.

Pursuant to section 2. Of Land Act 1036 2020, Allodial title is the highest ownership of land without any encumbrance from an overlord. Allodial interest may be acquired through the following; compulsory acquisition, conquest, Gift, Pioneer discovery/settlement, and Purchase or Agreement.

Evidently, all Boadi lands carry an Allodial title without any encumbrance from the overlord/goldenstool due to its classification as “Gift” granted by Osei Tutu I in 1688 to his wife, Oheneyere Achama Tutuwaa as a result of their marriage account and procreation. Wherefore the descendants of Oheneyere Achama Tutuwaa are the beneficial and lawful owners of all Boadi lands.

The Ashanti Regional Lands Commssion has refused to proceed with the family’s registration of title without any just cause. Whereas the royals have fulfilled all requirements stipulated in Section 207 of the Land Act 1036 2020. Evidently, all statutory fees have been duly paid to the Land Commssion. Find attached exhibit on payment receipt issued by lands commssion secretariat, Kumasi.

The town of Boadi is located within the Oforikrom Municipality in the Ashanti Region of the Republic of Ghana it’s bounded by towns, Anwomaso, Oduom, Ayeduase, Emina, and rivers Bokuro, twuwaa, adampasu and sub in.

More particularly described by the plan of land prepared by a Licensed Surveyor Anthony Ackah and approved on 18/12/2020 by Regional Director of Survey, Ashanti Region in favor of the Royal family.

This plan was duly stamped at the Lands Commission with Valuation number LVD/FC/ASR/3013/2021.

The only unique family property within the Kumasi traditional area tracing its roots of title per the family history as a “perfect gift” granted by the bearer of the Ashanti Golden Stool. Ghana’s Land Act 1036 2020 must be safely obeyed in its entirety to ensure a safe land turner in Ghana. I do not believe any Ghanaian Chief or traditional leader would rubbish Land Act 1036 2020
