The Accra High Court has dismissed the Contempt Application submitted against Member of Parliament for the North Tongu Constituency, Samuel Okudzeto Ablakwa.
This occurred after the court officiated over by Justice Charles Gyenfi Dankwa ruled that the application contained flaws and inconsistencies, and that the applicant was unable to prove the elements of contempt beyond a reasonable doubt.
The application was filed by the Secretary to the Board of Trustees of the National Cathedral, Kwabena Adu Gyenfi, also known as Rev Victor Kusi Boateng, after the MP was alleged to have disregarded an injunction application that prohibits him from continuing his crusade on cathedral matters.
A cost of 10,000 Ghana cedis was assessed against the applicant and awarded to Okudzeto Ablakwa.
The Court ruled on the application on Tuesday, May 2, stating that there was no proof of service on the court's transcript indicating that the MP was served with the processes.
The court also stated that there were discrepancies in the applicant's chronology of events, which should be to the respondent's advantage.
Murtala Inusah, EIB Network's Legal Affair Correspondent, was in court to report that, pending the outcome of the GRA investigation, the court ruled that Kwabena Adu Gyenfi and Rev. Victor Kusi Boateng are two distinct people with two different mothers.
According to a directive issued by the Chief Justice in November 2022, the Court ruled that the alleged process server was not a judicial Service-approved bailiff.
