Ghanaians Will Be The Ones To Suffer When I Sue Akuffo-Addo - Domelovo

Former Auditor-General Daniel Yaw Domelevo has declined to seek compensation for his unconstitutional "leave" in 2020, which was mandated and enforced by the presidency.

The Supreme Court eventually declared that the mandatory leave was unconstitutional and null and void.

In an interview with Citi FM hours after the ruling was issued on May 31, Domelevo stated that although he felt vindicated, he would not pursue the matter further because the individual culpable for his predicament was not a taxpayer.

"Many individuals have made such suggestions, but I joke that I wouldn't sue taxpayers who did nothing to me for recompense. "Since the president does not pay taxes, I have no interest in taking any further action," he stated.

Regarding his termination, he stated, "I've moved on... I believe that the verdict is the most important factor."

Civil Society Organizations filed a lawsuit alleging that the president's directive that Domelevo take 169 days of accumulated leave prior to his retirement compromised the Auditor-General's office's independence and constituted an attempt to obstruct anti-corruption initiatives.

On Wednesday, May 31, 2023, the Supreme Court upheld the suit, declaring the president's directive "unconstitutional and null and void," bringing to a close two years of legal disputes resulting from the president's refusal to rescind the directive.

Mr. Domelevo expressed his approval of the court's ruling during an interview on the Accra-based JoyNews program Upfront on May 31.

"I did not feel overjoyed, but I did feel vindicated when the decision was rendered. When I wrote to the president's office to bring his attention to the unconstitutionality of the president's directive, I was told it was because I am not a lawyer and do not understand the law. "I am pleased that those in whose bosom the interpretation of the constitution and the laws resides have affirmed my position," he said.

He continued, "I am ultimately content because my successors will not have to endure this again."

Mr. Domelevo believed that the verdict would deter similar illegal actions against his successors, and he hoped that future prudence would be exercised to prevent a repeat of the situation.
