Dapaah case: State granted two-week request to conclude investigations

The court has granted the State Prosecutors’ plea to postpone the case for two additional weeks so that detectives can wrap up their probe into the case alleging a theft of almost $1 million and 300,000 euros from Madam Cecilia Dapaah’s home.

Seven people have been charged with 14 counts: Patience Botwe, 18, a hairdresser; Sarah Agyei, 30, an unemployed person; Benjamin Sowah, 29; Malik Dauda, 34; a trader; Job Pomary; and Yahaya Sumaila, an excavator operator.

As prosecutors claim their investigations are coming to a close, their respective pleas have not been accepted.

In court on Tuesday, August 22, Akosua Agyepomaa Agyemang, an Assistant State Attorney from the Office of the Attorney General, and ASP Emmanuel Nyamekye requested a two-week adjournment to conclude investigation.

The defense attorneys didn’t object to the request.

A formal application for bail was made by attorney Abdul Basit on behalf of Job Pomary, the sixth accused in the investigation who is facing a preliminary accusation of collecting $300,000 dishonestly.

The prosecution did not object to his request for bail either, and the Assistant State Attorney claims that this is because the sixth accused’s case has been thoroughly investigated.

Pomary, the sixth accused, was granted bail in the amount of GH300,000 with two sureties to be justified by Her Honor Mrs. Afia Owusua Appiah.

The court stipulated that the sureties must be under its purview, and the accused must also surrender his passport at the court registry.

Additionally, he has until another date to report to the police once every four nights (every two weeks).

The Court rejected an attempt by some of the accused persons’ attorneys to resubmit their oral bail application.

Since then, the sitting court has ordered them to arrive by official application.

September 5 has been set aside for the case.

Lactating mothers still on remand

Murtala Inusah, the Legal Affairs Correspondent for EIB Network, writes that the two breastfeeding moms of the seven people had broken the terms of their bail.

When the charge sheet was changed on August 8, 2023, Sarah Agyei and Christiana Achab—both of whom claimed to be nursing mothers—were each given a million cedis in bail, to be backed by three sureties.

The sureties are also required to leave their Ghana Cards with the court’s registrar and refrain from leaving the area.

They haven’t complied with their bond requirements, though, so they remain in detention legally.
